When am I considered to be an employee?
You are entitled to a pension as an employee if you worked in Belgium with an employment contract as a:
- manual worker;
- office worker;
- contractual civil servant;
- miner;
- mariner;
- professional journalist;
- member of a civilian aircrew.
For these last four categories, special pension schemes exist (these are, with the exception of the scheme for professional journalists, being phased out).
Your employer must deduct NSSO contributions from your wages, otherwise you will not build up pension entitlements. If the NSSO did not receive these contributions, you can, in certain cases, regularize these periods by voluntarily paying personal and employers' contributions.
If you are exercising a flexi job but have not yet retired:
- your employer will also pay NSSO contributions for your employment
and - you are entitled to an employee pension for this period.
Please note: you can also receive a Belgian pension if you worked abroad for an enterprise that has its main office in Belgium.
When am I considered to be a contractual civil servant?
If you work in the public sector but are not established, you are a contractual civil servant and you are entitled to an employee pension.
You were established after 30 November 2017? You are entitled to:
- an employee pension for the period before your establishment;
- a civil service pension for the period after your establishment.
Exception: temporary work in education will always entitle you to a civil service pension if you are later established in your position.
You were established before 30 November 2017?
Except in exceptional cases, the periods as a contractual civil servant before your establishment are taken into account for your civil service pension, on the condition that you were paid by the Treasury.
You will receive a civil service pension for these periods, and not an employee pension.
If you worked on a contractual basis in one of the following organizations, these periods are not taken into account for your civil service pension (though they are taken into account for your employee pension).
- UZ Gent;
- CHU de Liège;
- Société wallonne des Eaux (SWDE);
- Belgischer Rundfunk (BRF).
