When am I considered to be a civil servant?

You are entitled to a civil service pension if you were established with:

  • the federal government (included: the army, the magistrature, the recognised religious services and some special corps such as the Treasury, the Council of State, ...);
  • the regions;
  • the communities;
  • the provinces;
  • the municipalities and the Public Social Service Centres (OCMW);
  • the intermunicipal companies;
  • the intermunicipal utility companies;
  • some institutions of public interest;
  • the Belgian National Railway Company;
  • Proximus, bpost, BAC, Belgocontrol, …;
  • the integrated police;
  • the magistrature.

Certain temporary or contractual services in the public sector that were performed before your establishment can be taken into account for your civil service pension on the condition that:

  • you were established on 30/11/2017 at the latest (exceptions: temporary work in education and work as a judicial trainee are always taken into account for the civil service pension if these were followed by an establishment);
  • you were paid by the Treasury;
  • you worked in a grade in which it was possible to be established at that time.

Are taken into account:

  • work in the public sector within the framework of a youth work placement;
  • work as a subsidized contractual worker;
  • work as a contractual worker.

Are not taken into account:

  • work as an employed unemployed person (EUP);
  • work within the framework of the Derde Arbeidscircuit (DAC) (a temporary job scheme);
  • work within the framework of the Bijzonder Tijdelijk Kader (BTK) (an employment creation programme).

Persons who fell within the scope of these employment programmes:

  • remained registered as in search of employment;
  • were not paid by the administration that employed them (in many cases, they received a raised benefit paid by the NEO).

You are an established civil servant, but you lost your pension entitlements (for example because of a disciplinary measure)?

You are no longer entitled to a civil service pension, but to an employee pension.
