Payment to third parties
A third person cannot receive your pension in your stead.
However, there are three exceptions:
Debt mediation (through a debt mediator)
We speak of debt mediation if the labour court:
- has accepted the request for collective debt settlement;
- has appointed a debt mediator.
The debt mediator:
- contacts the Federal Pensions Service (FPS);
and - informs the FPS of his appointment;
and - informs the FPS of the financial account number that has been opened in the name of the pensioner.
There are attachments or other deductions on the pension amount within the framework of debt recovery? These are suspended as soon as a debt mediator has been appointed. From that time on, any attachments or deductions are paid to the debt mediator.
The person who was granted a collective debt settlement also has a debt with the FPS? The FPS will send the debt mediator a claim for repayment.
Temporary management of property (provisional administrator)
The pensioner is unable to manage his property? If so, the justice of the peace can appoint a provisional administrator who will manage his property.
The provisional administrator:
- contacts the Federal Pensions Service (FPS);
and - informs the FPS of his appointment;
and - informs the FPS of the financial account number that has been opened in the name of the pensioner.
If the provisional administrator's ward dies, he has to inform our services immediately.
When the provisional administrator's mandate ends, he also has to inform the FPS.
Confinement
Confinement in a prison or in an institution for the protection of society may have an influence on the payment of the pension or other benefits that are paid by the Pensions Service.
Employee and self-employed worker pensions
After 12 uninterrupted months of confinement, the pension payment is suspended.
These 12 months start in the month following the date of confinement.
During these 12 months, the pension can be paid into a personal current account or in the prison director's account.
We resume the payment in the month following the release.
The spouse can receive 50 % of the household rate pension during the entire period of the confinement.
Civil service pension
After 12 uninterrupted months of confinement, the pension payment is suspended.
These 12 months start in the month following the date of confinement.
During these 12 months, the pension can be paid into a personal current account or in the prison director's account.
We resume the payment in the month following the release.
The extra guaranteed minimum allowance is suspended from the month following the confinement. We resume the payment of this extra allowance on the first day of the month of the release.
Guaranteed Income for Elderly Persons (GIEP)
The payment of the GIEP is suspended from the month that follows the confinement.
We resume the payment in the month following the release.
Specific situations
- The industrial accidents interests remain payable, even after 12 months of confinement.
- If the entitlement to a pension starts when the person concerned has already been imprisoned:
- during at least 12 months, we immediately suspend the payment until the month following the release.
- during fewer than 12 months, we pay the pension until the 12 months of confinement have been reached. After this, we suspend the payment until the month following the release.
- Persons who have been admitted to the following psychiatric institutions, continue to receive their pension or GIEP:
- UPC Bierbeek
- Les Marroniers in Tournai
- Chênes aux haies in Mons.
